The application is filed for grant of leave to file appeal against the order made by learned J.M.F.C., Dondaicha in S.T.C. No.436 of 2003 (Old No.591 of 2001 in the Court of J.M.F.C., Sindkheda). The complaint is dismissed for the reason that no effective steps were taken by the complainant for service of summons of the case and the accused is discharged.

Learned counsel for the applicant submitted that statutory notice was given by the complainant for filing case under section 138 of Negotiable Instruments Act

-:(2):- and it was replied by the accused and on the same address was given. He submitted that such tactics are played by the accused but the complainant has suffered due to the tactics of the accused. In view of the nature of order made by the Court of learned J.M.F.C., application is allowed. Leave is granted.

Appeal is admitted.
