CORAM : S.S. SHINDE & P.R. BORA, JJ.

Dated: May 06, 2015 ...

PER COURT :- 1) Perused the grounds pleaded in the Petition and also affidavit in reply filed on behalf of Respondents No. 1 and 3. It appears that, Petitioner's prayer for appointment on compassionate ground has not been considered principally on the ground that, the Petitioner's record shows, he is from Muslim Religion, and there is no mention of 'Bhangi' in the said record. Learned Advocate appearing for the Petitioner has made available original caste certificates for our perusal, which are also seen by the learned AGP appearing for the Respondent State. All the three certificates does find mention of 'Bhangi'. In that view of the matter, we direct Respondent No.

3 to consider the request of the Petitioner for appointment on compassionate ground in the light of recommendations of Lad and Page committee as expeditiously as possible, preferably within three months from today. 2) Needless to observe that, Petitioner will be at liberty to produce on record copy of the caste certificate and also all other documents for perusal of Respondent No.3 , if it is necessary, Respondent No.3 shall afford an opportunity of hearing to the Petitioner and take decision within three months from today.
