PER COURT :- 1.

Delay of 91 days has occurred in filing the present application by the State. The reasons are assigned in paragraph Nos. 2 and 3 of the application. Learned Counsel appearing for the respondent though has opposed for condonation of delay, stating that the reasons are insufficient, for the reasons in the application which, according to me, cannot be outrightly rejected, I am inclined to allow the application. Hence, following order:

ORDER

The Application for condonation of delay is allowed and disposed of. Delay in filing the appeal is condoned. 2.

The Criminal Application seeking leave to prefer appeal be registered and on registration issue notice to the respondents. Learned Counsel Mr. A.G.Ambetkar for respondent waives service. Service complete.

List the application seeking leave to prefer appeal for further consideration after four weeks.
