The present petition takes an exception to the order dated 4th July 2014 passed by respondent No.2 - Tahsildar, Karjat on the ground that the said authority has exceeded his jurisdiction in passing the order.

Admittedly, remedy of appeal is available to the present petitioner against the said order.

In the light of above, the learned Counsel for the petitioner seeks leave of this Court to present an appeal against the said order before the Sub Divisional Officer, in accordance with the relevant provisions of the Maharashtra Land Revenue Code. Leave granted. It shall also be open for the petitioner to prefer an application for stay before the Sub Divisional Officer, Karjat and the said authority is required to decide the said application for stay on its own merits and may impose such condition in case of grant of stay as it deems fit in the facts of the case.

The petitioner undertakes that the appeal and the application shall be preferred within two weeks from today. 5.
The interim arrangement ordered by this Court on 25th August 2014 shall continue for a period of two weeks from today. 6.
Writ Petition stands disposed of in above terms with no order as to costs.
