Mr. Sayyed, learned Advocate appearing for petitioner endeavours to contend that although remedy of Appeal is available against impugned order of disqualification passed by District Collector, Beed, for the reason that petitioner was not given sufficient opportunity of being heard. Challenge to impugned order can be entertained in Writ jurisdiction.

When this Court shown disinclination to entertain writ petition, Mr. Sayyed seeks permission to withdraw with liberty to file Appeal before learned Divisional Commissioner at Aurangabad. 3.

In that view of the matter, Writ Petition stands disposed of as withdrawn. In case Appeal is filed within two weeks from today, time consumed in prosecuting present Writ Petition shall be considered for counting limitation. In case of registration of
