IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 8942 OF 2024 Sureshchandra Ramdas Mehta Through Poa Milan Sureshchandra Mehta

VERSUS

Nikhil Suresh Chandiwal *** • Mr. A. N. Sabnis, Advocate for the Petitioner • Mr. V. B. Patil, Advocate for the Respondent *** CORAM : R. M. JOSHI, J DATE : JANUARY 23, 2025 PER COURT :

1.

After hearing learned Counsels for both sides when this Court found that there is no reason to cause interference into the order of production of documents by the Trial Court, learned Counsel for the Petitioner, on instructions, seeks withdrawal of the petition. He however apprehends that in view of observations made by Trial Court in paragraph 4 of the order, the authenticity/genuineness of the document would be considered at the time of judgment. This, according to him, will deny the opportunity to the Defendants to substantiate his case with regard to these documents. He, therefore, seeks leave to make submissions before the Trial Court in this regard.
