IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CRIMINAL APPLICATION NO.2107 OF 2023 IN BA/1728/2021 PRADIP @ SONYA RAMBHAU YEVALE

VERSUS

THE STATE OF MAHARASHTRA ...

Advocate for Applicant : Ms. Rashmi S. Kulkarni APP for Respondent : Mr. K. S. Patil ...

CORAM :

S. G. MEHARE, J.

DATE :

31-07-2023 PER COURT :- 1.

Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

2.

There are no complaints against the applicant that he has breached bail condition imposed upon him by order of this Court, in Bail Application No.1728 of 2021, dated 25.01.2022. 3.

The applicant is complying with the bail condition not to enter the village Dighol (Deshmukh) since January 2022. 4.

Considering the progress, the charge was framed long back, but thereafter there was no progress in the trial. Considering the reasons in the application and following the condition obediently, the Court is of the view that this is a fit case to relax the bail condition. Hence, the order:- i) Application is allowed.

ii) Condition No. (ii) in order dated 25.01.2022 in B.A.No.1728 of 2021, 'not to enter the village Dighol (Deshmukh) till the conclusion of the trial', stands relaxed.
