Mr. Deepak Kashiram Rajput, Advocate for the Petitioner Mr. A. B. Girase, GP for Respondents/State Mr. Nirmal Ramchandra J., Advocate for Respondent No.3 & 4 AND 934 WRIT PETITION NO. 7253 OF 2025 SHAIKH MOHSIN S/O SHAIKH YASEEN AND ANOTHER
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Mr. Deepak Kashiram Rajput, Advocate for the Petitioner Mr. S. D. Ghayal, AGP for Respondents/State Mr. Shrinivas M. Ganachari, Advocate for respondent Nos.3 and 4 ....
CORAM : MANISH PITALE AND Y. G. KHOBRAGADE, JJ.
DATE : 20.08.2025 PER COURT :- 1.
Heard learned counsel for the petitioners.
2.
Initially, the learned counsel for the petitioner sought to rely upon the provisions of the Maharashtra Government Servants Regulation of Transfer and Prevention of Delay in Discharge of Official Duties Act, 2005, but thereafter, he concedes that the said Act would not apply to the petitioners, as they are employees of the
(( 2 )) 933 & 9334 Zilla Parishad.
3.
It is also not seriously disputed that the transfers of the employees like the petitioners are governed by the Government Resolution dated 18.06.2024. The petitioners are due for transfer, but according to the petitioners there are certain serious irregularities, which go to the root of the matter and that such issues are required to be decided. 4.
It is also undisputed that the petitioners have already approached the Chief Executive Officer of the Respondent Zilla Parishad at Jalna, raising the said grievances. Clauses 2.4 and 5.10 of the aforesaid Government Resolution dated 18.06.2024, clearly provide for alternative remedies for the petitioners to raise their grievances. 5.
Since the petitioners have already approached the Chief Executive Officer of the Zilla Parishad, these petitions can be disposed of by issuing appropriate direction.
6.
In view of the above, Respondent No.3, the Chief Executive Officer, Zilla Parishad, Jalna is directed to decide the representations made by the petitioners as expeditiously as possible, and in any case, within four weeks from today.
7.
The petitions are disposed of in above terms. Pending applications, if any, also stand disposed of. [ Y. G. KHOBRAGADE, J. ] [ MANISH PITALE, J. ] HRJadhav
