Heard learned counsel for the petitioner and learned A.P.P. for the respondents.

Pursuant to the directions issued to respondent No.2, he has filed affidavit in reply. In para 12 of the affidavit in reply, it is stated that though the investigation officer has submitted closure report, if any positive clue regarding the offence is received or intelligence is collected, the investigation of this offence will be re-started. The Investigating Officer has formulated special team to trace out the accused involved in the crime and detect the same. 3.

So far as the prayer of petitioner to transfer the investigation to

crwp760.16 -2some other officer is concerned, it is not disputed that the petitioner had filed criminal writ petition No. 155 of 2016, which was disposed of by this Court on 13.4.2016 (Exh. "D" page 20), relying upon the statement made by learned A.P.P. In that view of the matter, prayer of the petitioner for transfer of investigation to some other officer is set at rest by order dated 13.4.2016.

For the aforesaid reasons, we do not think it necessary to keep this petition pending. Accordingly, writ petition stands disposed of. ( V. K. JADHAV, J.) ( S. S. SHINDE, J. ) rlj/
