Present application has been filed for fixing the date for final hearing. Mr. Chapalgaonkar Advocate was appointed as Special Counsel in this matter. However, he has filed a purshis for discharge that means he is discharged. Since he does not want to represent the appellant, that means by default learned Govt. Pleader will have to take the initiative. It appears that initially the suit was filed by the present respondents in the year 1984. Thereafter, the appeal was filed in 1993.

2 924 CA 9410-2018 The second appeal is pending since 2002. It is submitted that earlier the matter was fixed. However, due to some reasons it could not reach. Taking into consideration the fact that even the legal representatives who have been brought on record in place of initial parties. They are also senior citizens. The application is allowed and disposed of with direction that the matter be placed for final hearing on 4.3.2019.
