Heard learned Counsel for the respective parties. 2.
The petitioners challenge the order dated 24.04.2023 passed by the learned Presiding Officer, University and College Tribunal, Aurangabad in Misc. Application No. SRTMU 2 of 2022, whereby the learned College Tribunal allowed the application filed by respondent No.1 and condoned the delay.

Learned Counsel for the petitioners submits that while filing the application for condonation of delay, certain documents, purporting to be interpolated, were submitted before the learned College Tribunal. He further submits that though the enquiry report was placed on record along with the affidavit-in-reply, the said issue was not properly considered by the learned College Tribunal.

Per contra, learned Counsel for respondent No.1 submits that the learned College Tribunal has considered the matter, all submissions were duly dealt with, the delay was satisfactorily explained and therefore, the same was rightly condoned.

I have gone through the order passed by the learned College Tribunal. As the specific issue regarding interpolation was not considered therefore, without going into other aspects of the matter, it would be appropriate to quash and set aside the order passed by the learned College Tribunal and remand the matter for fresh consideration. 6.
In view thereof, the Writ Petition is allowed. The order dated 24.04.2023 passed by the learned Presiding Officer, University and College Tribunal, Aurangabad in Misc. Application No. SRTMU 2 of 2022 is quashed and set aside. The application is restored to its original position.

The learned College Tribunal, Aurangabad shall consider all the grounds raised by the parties and decide the application afresh. All the points are kept open.
8.
