The application is filed for transfer of Spl. Civil Suit No. 6/2014, presently pending in the Court of the Civil Judge [Sr. Division], Vaijapur to the other Court as the matter is not making progress. Heard learned counsel for the applicant.

The Suit is filed for specific performance of contract of sale of immovable property and the present applicant/defendant has grievance that the progress in the proceeding is stopped. Xerox copy of Roznama is produced to show that case is not making progress.

In view of these circumstances and considering the relief claimed, this Court holds that some direction needs to be given to the trial Court. So, the trial Court is directed to expeditiously dispose of the proceeding, in any case within 5 months from the date of receipt of the order of this Court.
