BENCH AT AURANGABAD 25 WRIT PETITION NO.8217 OF 2023 VIMALBAI SHANKARLAL SHANKARPELLI AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA THROUGH THE SECRETARY AND OTHERS ....

Mr A. L. Kanade, Advocate for Petitioners;

Mr P. K. Lakhotiya, A.G.P. for Respondents/State Mr A. M. Gaikwad, Advocate for Respondent Nos.2 to 6 CORAM : RAVINDRA V. GHUGE AND Y. G. KHOBRAGADE, JJ.

DATE : 17th July, 2023 PER COURT:

1.

The Petitioners' case is, that their orchard was practically burned down because of the sparks from the electric lines on the pole of 11 KV high voltage power line, that is laid in the middle of their land. They have moved a detailed claim dated 27/01/2023 before the Deputy Chief Executive Engineer, Sillod, Respondent No.6.

2.

Since an innocuous prayer is put forth, we are not issuing notice. Suffice it to say that, Respondent No.6 would deal with the claim of the Petitioners, dated 27/01/2023, provided it is

8217.23wp (2) vested with jurisdiction, and by following the due procedure laid down in law, a decision may be arrived at within 90 days. If the procedure prescribes an opportunity of hearing to all the stakeholders, such procedure shall be followed while taking a decision in the matter. If the Petitioners are aggrieved by the said decision, they would be at liberty to avail of a remedy, as is permissible in law.

3.

This petition is disposed off.
