This is an application for grant of anticipatory bail since the applicant is apprehending his arrest in connection with Crime No. 72/2015 registered with Shrirampur police station, District Ahmednagar for the offences punishable u/s 354,323,504,506 of the Indian Penal Code. 2.

Heard Mr. A.M.Karad, learned counsel for the applicant and Mr. A.S.Shinde, learned A.P.P. for respondent - State.

From the F.I.R., it is crystal clear that the dispute has occurred on the trifle issue of cricket ball when the said game was being played by the son of the first informant and his friend Ajinkya. Said ball struck to the window of the present applicant and on that, after the verbal altercation, applicant has assaulted by fist and kick blows. These are the allegations made in the F.I.R. Statement of independent witness Sarubai is available on record. It does not reflect any overt act against the present applicant. In that view of the matter, applicant has made out case for anticipatory bail. That leads me to pass the following order.

(i) Present Criminal Application is hereby allowed.

(ii) Interim relief granted in favour of applicant on 06/07/2015 stands confirmed.

(iii) With these observations, present Criminal Application is disposed of.
