DATED : 20 th July, 2015 PER COURT :- 1] Heard Shri G.V.Wani, learned counsel for applicant and Shri A.S.Shinde, learned Additional Public Prosecutor for the respondent/State.
2] This is an application for anticipatory bail. The applicant is apprehending his arrest in connection with Crime No. 63 of 2015, registered with police station Nashirabad, District Jalgaon, for the offences punishable under Sections 397, 394, 341, 323, 504, 506 r/w 34 of the Indian Penal Code.
3] The first information report is lodged by Vitthal Shriram More, a hotel owner, who himself is injured. The first information report states and attributes a specific role against the present applicant. Name of the present applicant is specifically taken in the first information report. In the first information report, it has been stated by the first informant that the present applicant by means of sharp edged weapon has assaulted on him and in order to avoid the same the first informant took the said on his left hand.
crap3487.15 4] The injury certificate of first informant Vitthal is available in the investigation papers. The injury corroborates the version of the first informant. The first informant has received the incised wound 7 x 1 x 2 cm. on left palm, and also suffered other injuries. In that view of the matter, custody of the present applicant is absolutely essential. 5] Hence, application is rejected. Interim order, granted on 6.7.2015 stands vacated.
