PER COURT:- 1.

The proposal for correction of date of birth in the school record is rejected by the Education Officer only on the ground that the petitioner has left the school.

Reference is made to the judgment of the Full Bench of this Court in the case of Janabai d/o Himmatrao Thakur Vs. State of Maharashtra and Others reported in 2019(6) Mh.L.J. 769 that in case of an obvious mistake, the same can be corrected even after the student has left the school.

In light of the above, the impugned order is quashed and set aside.

The Education Officer shall reconsider the proposal and shall arrive at conclusion, as to whether it is a case of an obvious mistake and thereafter, take decision afresh. The Application shall not be rejected only on the ground that, the petitioner has left the school. The same shall be decided preferably within a period of four (04) months.

Writ Petition is disposed of. No costs.
