Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.673 of 2024 registered with Kotwali Police Station, District Ahmednagar for the offence punishable under Sections 306, 323, 504, 506 of the Indian Penal Code.

It is an unfortunate that the deceased son of 17 left suicide note alleging against his father/applicant that he was not treating him well is one of the reason to commit the suicide. A long history of behaviour of the applicant has been narrated in the FIR by his wife.

The applicant has a case that the deceased was suffering from mental depression OCD. He had a tendency to commit suicide.
(2) He tried to commit suicide two times before the incident. He was saved from those occasions. Same reasons he has mentioned in the suicide note. As per the FIR, last incident with the deceased happened on 20.04.2024 and the deceased committed suicide on 29.05.2024. Therefore, the applicant never abetted the deceased to commit suicide. On the contrary, the applicant provided him a treatment.

The depression and OCD is a disease in which the suicidal tendency is developed. The deceased was under treatment for that disease. From the suicide note, it appears that the deceased was having a feeling that people understood him gay. The disease to the deceased may be a major reason. He committed suicide after a long gap of last scolding. In the facts and circumstances of the case, the applicant deserves bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant, Sandip Laxman Mandge, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial regularly.
(3) (b) The applicant shall not threat his wife.
(c) The applicant shall attend the concerned police station as and when called on written notice by the investigation till filing the charge sheet.
