DATE : JULY 27, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0194 of 2022 registered with Waluj Police Station, Dist. Aurangabad.

Heard learned counsel appearing for the parties. 3.
Pursuant to a tip-off that one person namely, Tarasing Tak was in possession of ALPRACAN 0.5 tablets (Alprazolam Tablets IP 0.5 mg) for being sold unauthorisdely, a trap was laid. He was apprehended at Waluj on 17.06.2022. He was found in possession of 248 ALPRACAN 0.5 tablets (Alprazolam Tablets IP 0.5 mg). During
BA.999.2022 interrogation, he first gave name of one Shivprasad Changhate, proprietor of Shiva Medicals. During interrogation of Shivprasad Changhate, name of one Mahesh was disclosed as supplier of such tablets. Mahesh, in turn, came to be interrogated who disclosed name of Ganesh (present applicant) as supplier of such tablets. Present applicant, therefore, came to be apprehended. 4.
It has come on record that the applicant is serving as a Salesman with M/s.Piyush Agency, a pharmaceutical shop. His involvement surfaced during the statement given by the coaccused. Except the same, there is, so far, no material to indicate his involvement in the crime in question.

Hence, the following order:- (i) The application is allowed.
(ii) The applicant be released in connection with Crime No.0194 of 2022 registered with Waluj Police Station, Dist. Aurangabad, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. (iii) The applicant shall not tamper with the prosecution evidence in any manner.
