Heard Mr. More, learned counsel for the applicant and Mr. Joshi, learned A.P.P. for the respondent.

One Amar Pandit Gade lodged first information report with police station Murud, District Latur alleging that the accused persons have misappropriated amount deposited by the complainant. On the basis of information lodged by the complainant, offence came to be registered against the applicant at Crime No. 26 of 2016 on 6.2.2016.

Mr. More, learned counsel appearing for

crap2887.17 the applicant submits that the alleged offence is dated 10.3.2014 and present applicant has already resigned from the post of Director of the Society and his resignation was accepted long back.

Learned A.P.P. also submitted same thing and has fairly conceded that there is no case made out against the present applicant, therefore, he may be released on bail.

Hence, following order.

(i) Criminal Application is allowed.

(ii) In the event of arrest, applicant be released on bail in connection with Crime No. 26 of 2016, registered at Murud police station, District Latur, on furnishing P.R. bond of Rs. 5,000/- with one surety in the like amount.

Criminal Application is disposed of.
