The petitioner is seeking transfer of investigation in crime no. 839 of 2021 registered with Parner Police Station, District Ahmednagar, for the offence punishable under Sections 302, 201 r/w Section 34 of IPC.

It transpires that for the very same relief, the petitioner had filed Criminal Writ Petition No. 123 of 2022 and it was dismissed as withdrawn by the order dated 27.06.2022. Even the petition itself, in page 9 para 5(I), mentions that this Court was not inclined to grant

948-CriWP-940-2022 -2any relief and when it was so expressed, that the Writ Petition was withdrawn.

It is a sheer abuse of the process of the Court. No such successive writ petition for the self-same relief should have been filed. We deprecate such practice and dismiss the petition.
