IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 8477 OF 2018 Anusaya Sevabhavi Sanstha Kanddhar & another Petitioners

Versus

The State of Maharashtra & others Respondents Mr. B.B. Shinde, advocate for petitioners.

Mr. S.G. Karlekar, A.G.P. for Respondents 1 and 2. CORAM : R.M.BORDE & MANGESH S. PATIL, JJ.

DATE : 08th October, 2018 PER COURT:

It appears that there are disputes between the Management, which has resulted in filing several proceedings and the instant petition is also an outcome of such dispute. It would be open for the petitioners to avail of the remedy available in law. It is made clear that the disputed questions, those are raised in the petition, need not be gone into in this petition. The Education Officer has taken a decision in the interest of teachers and students of the school. The said decision can be impeached before proper forum in observance of the procedure prescribed in that behalf. No case is made out to exercise extraordinary jurisdiction of this Court under Article 226 of the Constitution of India. Petition is devoid of substance. Hence writ petition stands dismissed.
