Umaji Bapurao Mulgir v. The Additional Collector And Others
{1} wp6927-15 drp
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.6927 OF 2015 Umaji Bapurao Mulgir PETITIONER
VERSUS
The Additional Collector & others RESPONDENTS .......
Mr. Mahesh P. Kale Advocate for the petitioner Mr. S. K. Tambe, AGP for respondent State Mr. B. A. Shinde, Advocate for respondent No.6 .......
[CORAM : SUNIL P. DESHMUKH, J.] DATE : 9 th JULY, 2015 ORDER :
1.
Heard learned advocate for the petitioner. Principal thrust underlying the submissions is that no proper verification of requisition had taken place, for, according to the petitioner, it cannot be said that the requisition was by genuine members of Gram Panchayat.
2.
It appears that pursuant to the requisition, notices were issued, convening a meeting for no confidence against the petitioner, who happened to be sarpanch of the Gram Panchayat. Out of nine members of the Gram Panchayat, seven members attended the meeting and passed the no confidence motion
{2} wp6927-15 unanimously by a margin of seven against zero. The matter was taken before Collector by the present petitioner, taking up the contention, as referred to hereinabove, wherein the members of gram panchayat, who had requisitioned meeting for no confidence had also appeared. It is not the contention of members of gram panchayat that they had never requisitioned meeting for no confidence. The petitioner also does not dispute that gram panchayat members had appeared in the proceedings before the Collector.
3.
Since, said seven members had not objected to requisition and do not have any doubt about that the requisition was by them and accordingly had attended the meeting, I do not think it would be proper for the petitioner to object to the requisition on the ground sought to be pressed into service. 4.
Taking into account that main thrust being rendered untenable, I do not see any substance in the writ petition. Writ petition, as such, stands rejected.
