The petitioner's grievance is with regard to her transfer at Kinwat. The learned counsel for the petitioner submits that, the petitioner is in preferential group and seeks benefit of couple convenience. The Commissioner has rejected the claim of the petitioner. According to the learned counsel vacancy exists at the place where the petitioner seeks to be absorbed. 2.

According to Mr. Pulkundwar, the learned advocate for the respondent No. 3 that, there are two teachers for science subject already working and for science and math, one teacher can teach all these subjects. The learned advocate further submits that,

2 wp 7534.19 vacancy cannot be kept at Kinwat being a naxalite area. 3.

As per Government Resolution dated 28.05.2019, if the petitioner has any grievance with regard to her transfer, she has to make an application to the Chief Executive Officer. 4.

The petitioner may make comprehensive application to the Chief Executive Officer, Zilla Parishad, Nanded. The C. E. O. shall take decision upon application of the petitioner within a period of 15 days from the date of application and if the petitioner has any grievance with regard to her place of working against the order of the C. E. O. can approach the Commissioner. The writ petition is disposed of. No costs.
