1. Heard learned counsel for petitioner. 2.

Learned Assistant Government Pleader submits that application of the petitioner for regularization of his encroachment over the Gairan land was already rejected by the authority under communication dated 03-10-2013. 3.

According to learned counsel Mr. Gude, the Collector under communication dated 29-05-2013 has directed the Sub-Divisional Officer to make necessary enquiry. The Sub-Divisional Officer has rejected the claim of the petitioner for regularization of his encroachment over the Gairan land.

In the light of that, prayer made in present petition does not survive, however, the petitioner is at liberty to take up such proceedings in accordance with law to assail said order of SubDivisional Officer. 5.
