IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.7187 OF 2020 LOKATANTRA SENANI SANGH SAMITI AND ANOTHER
VERSUS
STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioners: Mr. S. V. Dixit AGP for Respondent/State: Mr. A. R. Kale ...
CORAM:RAVINDRA V. GHUGE AND ARUN R. PEDNEKER, JJ.
DATE: 23rd AUGUST, 2022 PER COURT:
1.
The Petitioners have put-forth prayer clause 'A', as under:- "A) For a writ of certiorari, order or directions in the nature of certiorari, calling for record and proceedings of Government Resolution dated 31.07.2020, issued by respondent No.2 and after examining legality, validity and propriety thereof, Government Resolution dated 31.07.2020, issued by respondent No.2 be quashed and set aside."
2.
The learned AGP places on record the Government Resolution dated 28.07.2022. He submits
2 wp 7187.2020 that the benefits made available to the detenues during the emergency period, vide Government Resolution dated 14.02.2018, were disrupted vide the Government Resolution dated 31.07.2020. The benefits available under the earlier Government Resolution were cancelled by the subsequent Government Resolution. With the introduction of the Government Resolution dated 28.07.2022, the period from which the scheme was cancelled i.e. from 31.07.2020 till the introduction of the Government Resolution dated 28.07.2022, would now be bridged by the restoration of the scheme. In view of the Government Resolution dated 14.02.2018, such continuity is being granted to the scheme and those applications which are pending under the said scheme would now be taken up and appropriate decisions, after due verification of each case, would be taken and such applications would be decided.
3.
Considering the above, the grievance of the Petitioners would be redressed as the pending applications, in the light of the Government
3 wp 7187.2020 Resolution dated 28.07.2022, would now be considered by the Government.
4.
In view of the above, this Petition is disposed off.
