Shri B.P.Gonare, learned advocate representing respondent Nos.3 and 4 in the first petition and respondent Nos.3 to 5 in the second petition, submits that the cause of these petitioners for seeking 100% grant in aid salary, is squarely covered by the judgment delivered by this Court on 06.07.2021 in Writ Petition No.7614/2020 filed by Prakash Dattatray Bagul vs. State of Maharashtra and others.

The learned advocate for the petitioners submits that he has placed the said judgment dated 06.07.2021 on record. 4.

The learned AGP confirms that these petitioners would be covered by the said judgment.

In view of the above, these Writ Petitions are allowed. The impugned orders dated 11.12.2018, 06.03.2019 and 27.11.2019, shall stand modified to the extent of the denial of 100% aided division salary to the petitioners, by the Education Officer. These petitioners would be entitled for transfer from the unaided post to the aided post in 100% grant in aid divisions. The corrected approval orders shall be issued by the concerned respondents as expeditiously as possible and in any case, on or before 31.08.2021. 6.

Needless to state, with this correction, the petitioners would be entitled for such approval from the dates on which they stood transferred to grant in aid divisions and the arrears of their unpaid difference in salary shall be paid as expeditiously as possible and in any case, on or before 30.09.2021.
