Perused the notes of evidence and in particular the contents of the dying declaration at Exh-27. Apart from it, there are three oral dying declarations. In that view of the matter, prima facie, the findings of the trial Court are sustainable. We do not think it appropriate to elaborate further on the evidence since the appeal filed by the applicant/appellant is pending before this Court. No case is made out for grant of bail to the applicant/appellant. Hence, the criminal application is dismissed.

The Registry of this Court shall send back the record and proceedings to the Registrar/Office Superintendent of the Court of Additional Sessions Judge, Kopargaon. Upon receiving the R & P, the office of the concerned Court shall prepare the paper-book and send the same to the Registry of this Court, as expeditiously as possible; however, within a period of three months from today. Upon receipt of the paperbook, liberty to mention for early hearing of the appeal is hereby granted.
