The applicant who is the original accused has filed this application seeking refund of the amount of Rs. 1,65,410/- deposited by him while his Criminal Application No. 91/2012 for anticipatory bail was being decided by this Court by the order dated 18.01.2012. Now that he has been acquitted. He is claiming the refund.

The learned A.P.P., on instructions, submits that the applicant has been acquitted and the Investigating Officer does not have objection if the money is returned.

The Application is allowed. The amount together with interest if any shall be refunded to him.
