Having regard to the contentions raised in the application for withdrawal of the deposited amount, and the objections raised in the memo of appeal in exception to the impugned award, I deem it appropriate to pass following order:

ORDER

1.

The applicant is permitted to withdraw 40 per cent of the deposited amount on furnishing an undertaking to the satisfaction of the Registrar (Judicial) of this Court. AGP/-

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD (2) CA NO.9346 OF 2016 The applicant is further permitted to withdraw 25 per cent of the deposited amount on furnishing Bank Guarantee of any nationalized or Scheduled Bank in the like amount. Balance amount be invested in Fixed Deposit receipt in any nationalized Bank, till disposal of the present appeal. Application disposed of.

Hearing of the appeal is expedited.
