Applicants seeks to condone delay, set aside abatement and bring themselves on record as heirs of deceased Pandurang Ramrao Bandgar.

The cause of action survives as against the legal heirs of original claimant. They are legatee to the will executed by the deceased. There is no reason to doubt the bonafides of the applicants.

The civil application is allowed in terms of prayer clauses

Either of the parties shall carry out the amendment within a period of two (02) weeks from today.
