Heard the learned advocate for the petitioner, learned ASG Mr.Deshpande, and Mr.Sonawane,learned advocate for respondents. 2] The petitioner challenges notice dated 13/5/2019 as unreasonable and unconstitutional. Upon hearing counsel for respective parties it does not appear that the said impugned notice in any way is arbitrary or unreasonable. The interpretation of the petitioner that it is only after declaration of NEET result, the application can be made is not in consonance with Clause 3 of the said notice. The notice states that a person meets the eligibility criteria including qualification in NEET (UG-2019) can apply for admission to UG course. It is not that those who have cleared NEET can only apply.

3] The time schedule was laid down to apply online for issue of

979 wp7659.19 ward of IP certificate i.e. upto 28/5/2019. Thereafter, the link is deactivated.

4] The admission process has already commenced and the second round would be on 9/7/2019 according to the petitioner. 5] We are not inclined to enter into reasons given by the petitioner for not being in a position to apply within stipulated period.

6] The petitioner may apply in a physical form to the respondent competent authority for issuance of ward of IP certificate. The authority may consider the application and if all the criteria are met with by the petitioner as is required under the admission notice dated 13/5/2019 and any other Rules and Regulations, then the respondent shall consider the application for issuance of ward of IP certificate on its own merits and if the same is possible.
