It is not disputed by both the learned Advocates appearing for the parties that the suit is posted for evidence. This petition challenges the order passed below Exhibit-5 by the Trial Court, which was allowed in favour of the respondent/original plaintiff. The Appellate Court has confirmed the Trial Court's order. Considering the fact that the suit is at the stage of evidence, this Court is not inclined to entertain the petition at this stage.

Writ Petition is, therefore, disposed of by directing the Trial Court to expedite the suit.
