The application is filed for permission to withdraw the amount deposited as per the judgment and order delivered by the Commissioner under Workmen's Compensation Act. Heard learned counsel for original complainant and learned counsel for owner.

This Court holds that the compensation amount of Rs.3,09,925/- needs to be disbursed as per the order made by the Commissioner. There is challenge to the order of penalty. That can be retained. The entire

The application is allowed. Make the disbursement of Rs.3,08,925/-. Undertaking is to be taken from mother and widow of the deceased to the effect that in case the owner succeeds they will repay the amount with interest at the rate of 9% p.a.
