The learned Counsel for the applicant, upon instructions, seeks liberty to withdraw the application.

Liberty, as prayed for, is granted in the interest of justice.

The learned Counsel for the applicant further submits that the applicant herein would appear before the concerned Judicial Magistrate (First Class), within one week from today i.e. by 20th July 2016.

The applicant is protected till 05.00 p.m.
of 20th July 2016. The learned Magistrate while considering the application under Section 437 / 439 of the Code of Criminal Procedure, 1973, shall not be influenced by the withdrawal of this Application and shall consider the application, if filed before the Magistrate, on its own merits.

With the above observations, the Criminal Application stands dismissed as withdrawn.

The learned Addl. Public Prosecutor shall communicate this order to the concerned Police Station.
