This petition was filed about five years back challenging order dated 6th May, 2010, passed by the Education Officer (Secondary), Zilla Parishad, Ahmednagar, refusing to grant approval to the petitioner's alleged appointment as a Head Mistress of the school, run by respondent No.3. Various reasons were given in the impugned order as to why the proposal could not be allowed. One of them was that one Mr. Kasab was appointed as a Head Master by following due process of law and therefore the post is already filled up. 2.

Learned Counsel for the petitioner states that Mr. Kasab, in the meantime, stood retired on

( 2 ) wp8027.10 superannuation. The post probably is now vacant and therefore the authorities would be able to decide the proposal for approval of the petitioner's appointment as a Head Mistress and can be reconsidered in changed situation.

We, hereby, permit respondent No.3-Management to submit a fresh proposal for approval of petitioner's appointment as a Head Mistress with immediate effect or with retrospective effect.

The authorities shall consider it in the light of changed situation within six weeks from the date of submission of proposal by respondent No.3.

The writ petition, accordingly, stands disposed of.
