The Petitioner is a widow. Her husband superannuated from employment on 30.09.2018, and passed away on 17.05.2020. Retiral benefits have been partly paid to the widow. 2.
We have perused the affidavit in reply dated 03.03.2023, filed by Shri.Trimbak Kamble, Chief Officer and Administrator, Municipal Council, Parali Vaijnath. It is clearly admitted in paragraph Nos. 2, 3 and 4 that the amounts due towards the Petitioner, around Rs.10,84,623/- and Rs.1,50,000/-, have already been paid. The khs/March 2023/8219
- 2 - remaining amount has to be paid. The Municipal Council does not have enough funds. It has every intention to make the payment. The learned Advocate for the Municipal Council submits that as and when the funds will be available, the amounts would be paid. 3.
Considering the facts as above and since the Petitioner before us is a widow, we deem it appropriate to direct the Municipal Council to pay the entire remainder amount in 4 equal installments. The first installment shall be paid on or before 15.04.2023. Similarly, the 2nd, 3rd and 4th installments would be paid on or before the 15th day of the months of May, June and July, 2023. 4.
