One Deelip Dadarao Sasane lodged complaint to the police station on 22.12.2016 alleging that on 22.12.2016 deceased Maruti Shinde came to Shrigonda to leave his brother by Indica Car. On the next day at noon time Maruti Shinde went to the school where his wife another accused Deepali was serving. Deceased quarreled with her and hence Deepali called the present applicants and

they beat the deceased due to which deceased sustained head injury. The injured was taken to the hospital, where he died on 25.12.2016.

Learned counsel appearing for the applicants submits that there are vague and general allegations against the present applicants, and therefore, they may be released on bail.

As against this, learned A.P.P. points out the contents of the first information report as well as the statement of witness Ashwin Sanjay Khude, from which it appears that on 22.12.2016 at about 1.00 p.m. present applicants dragged deceased Maruti up to some distance where both the applicants have assaulted deceased with kick and fist blows. Accused Shrikant assaulted deceased on his head with wooden log. Statements of witnesses are very much clear about specific role attributed to the applicants. There are eye witnesses to the incident. Deceased died due to the head injury.

Considering the above aspects and the fact that there is direct evidence against the present applicants, they are not entitled for bail.

Hence, Criminal Application is rejected.
