The petitioners have challenged the order passed by the learned Magistrate directing the Police to investigate on the complaint for offence under Section 306 read with Section 34 of Indian Penal Code and submit report.

The learned Addl. Public Prosecutor has placed on record copy of communication sent by Police Inspector, Police Station, Jintur, to the office of the Public Prosecutor on 25th November, 2016 in which it is stated that the investigation was conducted and "C" summary was filed.
03.
The learned Addl. Public Prosecutor and the learned Advocate for the petitioners states that in view of subsequent development, the challenge in the petition has become infructuous.
