PER COURT :- 1.

By this application for withdrawal of money, the applicant submits that the amount of Rs.2,15,264/-, deposited by the respondent is towards the difference in the subsistence allowance to be paid considering that the applicant was under suspension from 9.1.1995 till 30.4.2000. 2.

Shri Irpatgire, learned Advocate strenuously opposes the application and submits that this Court may direct the applicant to furnish a Bank guarantee.

This Court had heard the petitioner Bank on 2.3.2016 and the three writ petitions were admitted by this Court. However, interim relief was refused.

The amount at issue is with regard to the subsistence allowance for the period of suspension, which is not disputed. 5.

In the light of the above, this application is allowed. The applicant is permitted to withdraw amount of Rs. 2,15,264/-, along with accrued interest, by submitting an affidavit / undertaking that if, eventually, he is held to be dis-entitled to the said amount, the same shall be re-deposited by him in this Court within twelve weeks from the date of any such decision. akl/d
