After hearing learned counsel for parties, they reconcile to a position that the impugned order can be set aside and application can be considered afresh along with appeal, by giving opportunity to parties to re-argue on the application.

As such, impugned order dated 17-01-2015 passed by District Judge, Aurangabad on Exhibit-7 in regular civil appeal no. 284 of 2012 is set aside. Exhibit-7 stands restored to file and it be considered along with said regular civil appeal.
