The petitioner, who is the original plaintif, is aggrieved by the refusal of the relief of temporary injunction by the trial Court and confrmation of the said order in appeal.

The plaintif sought to prevent the defendants from using the pipeline and electric pump on the premise that the plaintif is the owner and only a person entitled to use the pipeline and electric pump.

I am not inclined to interfere with the well reasoned orders and the concurrent view of the Courts below.

However, considering the nature of the controversy, it would be appropriate if the learned trial Court decides the suit expeditiously. I am informed that the plaintif has stepped into witness box. The trial Court is, therefore, requested to dispose of the suit expeditiously and in any event, within twelve months. Subject to the aforesaid observations, petition is dismissed.
