The petitioner has appeared for final year B. Tech. (Computer). The validation proceeding is still pending. 2.

Mr. Thigale, the learned counsel appears for the respondent No. 3 and submits that, fees to the tune of Rs. 3,56,175/- is neither paid by the petitioner, nor reimbursed by the Government.

The respondent No. 3 may issue marks sheet to the petitioner. However, degree certificate and other documents shall not be issued to the petitioner until the petitioner produces validity certificate. The Committee shall endeavour to decide the

2 wp 7039.20 validation proceeding expeditiously. The petitioner shall also give an undertaking to the respondent No. 3 that in case the petitioner fails to get validity certificate, he will pay full fees to the respondent No. 3.

In the light of the above, the writ petition is disposed of. No costs.
