In view of the inadvertent statement made by the learned counsel for the petitioners, this court by order dated 15.03.2023, disposed of this writ petition. However, later on, it is revealed that the statement made by the learned counsel for the petitioners was incorrect and, therefore, now, the learned counsel for the applicants seeks leave to withdraw that statement.

The learned counsel appearing for the respondents has not contested the statement made by the learned counsel for the petitioners, on facts.

In view of the same, the order dated 15.03.2023, disposing of the present writ petition is re-called and the petition is restored, subject to the costs of Rs.1000/- to be paid to the Advocate's Association of Bombay High Court at Aurangabad. The amount to be deposited within a period of two (02) weeks from today. 5.

The civil application for restoration stands accordingly disposed of.

On the receipt being produced, list the petition, on 29.02.2024.
