Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail in Crime No.255 of 2022, registered with Kranti Chowk Police Station, District Aurangabad, for the offences punishable under Sections 396, 120-B of the IPC.

Perused the papers. The applicant is the owner of the vehicle, in which, the stolen property was allegedly carried. He has produced the rope used to tie the deceased watchman. However, he was not captured in the C.C.T.V. footage. His confessional statement may not be used against him. Considering the role attributed to him and evidence collected by the Investigating Officer, the Court is of the view that his

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SALIM AHAMED JABBAR AHAMED ANSARI be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.255 of 2022, registered with Kranti Chowk Police Station, District Aurangabad, for the offences punishable under Sections 396, 120-B of the IPC, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall submit his mobile number with an undertaking that he shall not change his mobile number till conclusion of the trial.

(c) He shall attend the trial on each and every date.
