Learned counsel for the petitioner upon instructions seeks liberty to withdraw the petition. The learned counsel for the petitioner submits that the learned Judicial Magistrate, First Class, Latur, had marked the report of the handwriting expert as Exh.141 without recording substantive evidence of the handwriting expert. At this stage it can be said that the purpose of accepting the said documents is only for the identification of the said documents and it cannot be said that the contents of the said documents are proved. Since the learned counsel for the petitioner is seeking liberty to withdraw the petition. Liberty as prayed for
( 2 ) crwp816.14 is granted in the interest of justice.

The writ petition stands dismissed as withdrawn. However it is made clear that all the contentions raised in this petition are kept open. Needless to say that interim relief granted vide order dated 18.09.2014 stands vacated. The learned trial court shall proceed with the matter in accordance with law.
