PER COURT :- 1.

The applicant prays for condonation of delay of 1484 days, recalling of order of abatement and for bringing the L.Rs. of the deceased sole respondent on record in the Writ Petition, which has been admitted by this Court.

Shri Shelke, learned Advocate files his vakalatnama for appearing on behalf of the L.Rs. - non-applicant Nos.1A to 1E. He prays for costs, which may be donated to the Advocates Association's Bar Library, High Court, Bench at Aurangabad 3.

Shri Warad submits that the applicant is the Social Forestry Department and is in difficult financial condition. 4.

In the light of the above and for the reasons set out in the application, the same is allowed. Delay of 1484 days caused is condoned and the applicant department shall deposit an amount of Rs.1,000/- with the Advocates Association's Bar Library, High Court, Bench at Aurangabad within a period of three weeks from today. Order of abatement is recalled. The legal heirs of the deceased respondent - Ramesh Yadav Tupe be brought on record forthwith.
