The learned Counsel for the petitioner submits that the petitioner is a project affected person. The respondents are not giving the appointment to the petitioner nor considering the claim of the petitioner. The learned Additional Government Pleader accepts notice for respondents.

A person from the project affected category cannot be given a direct appointment dehors of competition. The Reference can be had to the Judgment of the Full Bench of this Court in case of Rajendra Pandurang Pagare Vs. State of Maharashtra reported in 2009 (4) Mh.L.J. 961.

In view of the above, no relief can be granted to the petitioner.

The Writ Petition is disposed of. No costs.
