This application is moved for withdrawal of the amount deposited by the appellant - insurance company in this Court. The applicant is the claimants. Considering that there is already an award in favour of the applicant, it is desirable to allow them to withdraw the amount deposited in this Court along with interest. Keeping the amount idle in this Court is not in the interest of any of the parties. Considering this, following order :-

ORDER

(i) The applicant is permitted to withdraw 50% of the amount along with accrued interest deposited with the Commissioner under the Workmen Compensation Act, Parbhani, by filing an undertaking that in case the appeal is allowed, the applicant shall re-deposit the amount along with interest within 12 week from the date of such order.

(ii) The civil application is accordingly allowed and is disposed off.
