Delay in filing the Second Appeal is of 80 days. 3.

Reasons explaining the delay are set out in paragraph Nos.2 and 3 of the application.

The sole respondent has filed an affidavit-in-reply and has opposed the prayer for condonation of delay stating that the reasons are not satisfactory.

Upon considering the rival submissions, the Civil Application is allowed. Delay of 80 days is condoned, subject to costs of Rs.1,000/-. Shri Dhorde, learned Advocate graciously submits that the costs be deposited with the High Court Advocates' Bar Library, Aurangabad. Same be deposited within one week from today. After depositing the costs, the Appeal be registered.

Needless to state, in the event of non-compliance, this order shall stand recalled and the Civil Application shall stand rejected. 7.
