The present appeal is filed challenging order dated 17.07.2009 whereby the learned Principal District Judge, Dhule had refused to stay execution proceedings in enforcement of impugned arbitration award by rejecting the contention of the appellant that since Section 34 objection was pending, the award has not become enforceable in view of Section 36 of the Arbitration and Conciliation Act, 1996 as was then prevailing. Since then the 34 proceedings have been decided on merits.

In view of the aforesaid, the cause in the present appeal has become infructuous.
